This Agreement commences 1 January 2006 and will remain in force until 31 December 2008.
Sites that are currently licensed on a 'rolling-licence' basis under the Eduserv Chest/CA-Ingres Agreement will be eligible to participate in this Agreement from the expiry date of their existing licence until 31 December 2008, so that all licence end-dates of all participating Sites are coterminus. Licence fees in the Agreement year of licence transition will be pro-rated on a monthly basis if applicable. Subsequent annual fees will be as listed at Schedule 1.
The Agreement to which this refers is a formal Agreement between Eduserv and Ingres Europe Ltd.
This Agreement is only available to Institutions of Higher and Further Education and Research Councils in the United Kingdom that were licensed under the now expired Eduserv Chest/CA-Ingres Agreement.
Chest has had an Agreement for Ingres software since 1990 and the Agreement has been amended and extended a number of times since. The current Agreement has been drawn up to document the transfer of the product from Computer Associates to Ingres and to amend the licence conditions for all new licences that are issued from 1 January 2006 onwards.
It should be noted that, in line with all previous arrangements for Ingres, administrative use is permitted within the charges.
The Agreement covers:
- Ingres version 2.6 or earlier (versions 2.6 and 2.5 are the currently supported versions) which now has bundled in it the following products previously licensed seperately:
- RDBMS and user interfaces
- Query and reporting tools
- Applications by forms (ABF)
- Vision
- Ingres ICE (formerly known as Ingres Web)
The charges do not include upgrades and new versions, but bug fixes are included.
Full product descriptions can be found at Ingres' website: http://www.ingres.com/products.php"Authorised Users" are those individuals, who must be a currently registered student, faculty member or employee of the licensed institution, who are authorised by the licensee to access the licensee's information services whether from a computer or terminal on the licensee's secure network or off site via a secure access management system.
A walk-in user is a person who is not a currently registered student, faculty member or employee of the licensed institution, but is permitted to access the secure network only via a computer or terminal within the licensee's premises, and is deemed to be an Authorised User.

Evaluation copies of the Ingres product range are not available.
Site licence with standard Chest terms and conditions of use.
Copying of the Software is allowed at any licensed Institution for use in accordance with the standard "Code of Conduct for the Use of Software or Data".

At the end of the Agreement Period Licensed Sites are required to remove all copies of Ingres from their systems, unless they renew the licence for a further term under a new Agreement, should one be concluded.

Ingres Europe will provide updated and replacement Licensed Materials to each Licensed Site upon request if and when released.
Ingres Europe will permit Licensed Sites to copy Ingres and Licensed Materials within the terms of the Site Licence Agreement Appendix A to Schedule 4 - General Licence Conditions. At the end of each academic term Licensed Sites will make available to Ingres Europe, if required, a check-list of product copies taken.
Any training can be purchased from Ingres Europe at the standard rates in effect at the time such training is ordered.
One copy of system releases, patches and bug fixes for versions 2.5 and 2.6 will be sent by Ingres Europe to each Licensed Site upon request.
Ingres Europe will provide telephone advice and support to the nominated Technical Contact and/or his/her Deputy at Licensed Sites during normal business hours.
Although Licensed Sites are permitted to use versions of Ingres prior to version 2.6, currently support is only provided for versions 2.5 and 2.6.
In addition, a discussion list has been set up on JISCmail. This is called: chest-ingres. Anyone in the community may subscribe to this list (whether or not from a participating site).

Technical contacts at licensed sites are advised to join this list as it is used by Chest to communicate information relating to the Agreement.

* This fee is not payable by previously licensed sites that wish to extend an existing licence. Under these circumstances, the annual fee of £1500 will apply to each year of the extended licence.
Eduserv will invoice Licensed Sites for the initial fee on receipt of a completed Site Licence (Schedule 4). Eduserv will invoice Licensed Sites for the annual charge three months in advance of each subsequent anniversary date of the signing of this Agreement.
Sites that were licensed under the previous Agreement for Ingres between Computer Associates and Eduserv will be eligible to participate in this Agreement with a licence start date of 1 January 2006. Annual Licence Fees will be applicable from 1 January 2006 regardless of the date of joining the Agreement.
Sites that are currently licensed on a 'rolling-licence' basis under the CA Agreement for Ingres will be eligible to participate in this Agreement from the expiry date of their existing licence (dates shown at Schedule 2) until 31 December 2008 so that licence end-dates of all Licensed Sites are co-terminus. Licence fees in the Agreement year of licence transition will be pro-rated on a monthly basis if applicable. Subsequent annual fees will be as listed above.
To all the above charges will be added VAT at the prevailing rate.
On receipt of a completed Licence, Sites will be invoiced by Eduserv Chest for the first year of the licence. Subsequent annual fees will be invoiced by Eduserv Chest on the anniversary of the licence.
All payments must be made to Eduserv within 30 calendar days of receipt of a correct invoice.
The master copies of media and Licensed Materials will be delivered to the Licensed Site by Ingres when the Licence is signed by the Site and returned to Chest.
